Terms of Site Usage and General Terms

This Terms and Conditions sometimes can be updated without notice. Website, (website name) and its parent company (company name) may, from time to time, promote and offer other services than this Site and it can be governed by different Terms and Conditions.

Terms of Service Usage

At the moment we offer special fixed prices for our new front-end development clients and they are available at our order page. Email Template coding and complex front-end and CMS projects price is based on $35 – $45 per hour rates, depending on the complexity of the project and required skills to develop it.

There can be additional charges applied in case if project is complex and required additional effort. For example, unending scrolling of web pages longer than 2000px or complex UI / UX design for single web pages feature may be considered as an additional effort. We reserve the right to make changes or additions to our prices to the project after we begin to work on the project. Also, we reserve the right to rethink the quote or decline work on a project and make a refund if an actual scope of work that required for the project finishing is seriously exceeds fixed rate amount.

Expedited delivery service is available for extra charge.

Development Team: 8:00am – 5:00pm GMT / 3:00am – 12:00pm EST

Development Consultants and Live Chat Support: Monday-Friday, around the clock, with a 6-hour break: 11:00pm – 5:00am GMT / 6:00pm – 12:00am EST

 

Delivery timelines

The standard time of processing the first page of non-responsive HTML / CSS layout basically takes 6 working hours and 9 hours for the responsive page. Every additional or inner page of the same project usually takes 3-4 working hours, building on the specifications and how complex the project is.

The delivery timeline starts only after payment has been made and all order details has been clearly agreed and accepted for both parties. Order deemed to commence after your project manager gives you approximate delivery date. In that case you can track your order status in the Client Area of the Site.

Prospective timelines for CMS and JavaScript development are provided after investigation of the requested requirements and designs.

Acceptance

Default acceptance criteria are applicable to all projects and all project stages. A delivery is considered accepted if:

the client approves a delivery in the order thread or
the client does not send any feedback/change request within fourteen (14) days for markup project and within thirty (30) days for CMS integration / development projects.
the client has requested us to proceed with the next project stage. A project stage could be the next batch of HTML/CSS coding, JavaScript functionality, CMS development, deployment of the theme to an external server or delivery of the theme files in a zip archive.

delivery is approved by client in the order thread or
we will get no feedback/change request from the client within fourteen (14) days for markup project and within 30 days for CMS integration / development projects.
the client has requested us to start a new level of development. A new development level means a new batch of HTML/CSS coding, adding Javascript functionality, CMS development, deployment a web-site part on your external server or creating and delivering zip archive of the theme files.

 

Fixes/ Updates and post-delivery support

We provide all fixes (if any) for free until the project is accepted according to the “ACCEPTANCE” paragraph.

Any additional paid updates / changes are available by request.

Updates for implementation / development projects which were accepted and delivered over thirty (30) days prior to the request are subject to a deposit of three hundred (300) USD. In the list of services included eight (8) hours of project manager and / or developer time and is valid only for the next thirty (30) days.

All subsequent updates will cost forty (40) USD per hour.

Refund policy

A full refund will be based on the following reasons:

client’s order can not be completed;
a cancellation request was received before start of any works related to the project;

A partial refund will be based on the following reasons:

the client is reasonably and legitimately not satisfied with the quality of the code or service and provides exhaustive proof / explanation of the matter;
the client is not satisfied with the product result after the review on our test server. Refund extradition is possible after confirmation of both sides, and upon the clearance of all details related to the refund. If the order has been performed in accordance with the requirements of the customer, some small and insignificant errors should be recognized as acceptable and can not be a pretext for a full or partial refund.

 

Payment

Payments will be charged on a prepayment basis on the same day as the order creation. All refunds are provided in accordance with set forth in paragraph “REFUND POLICY” of this Terms of Service Agreement.

Post-payment is also available, after confirmation of the order, the customer accepts the condition to pay the agreed amount.

Content and Terms and Conditions

We reserve the right to reject any order without explanation. We will not provide services for any project or potential client for content which is offensive, illegal or which contains illicit or infringing material.

The Client is solely responsible for the provision, operation and use of all provided content including, but not limited to the following issues:

correspondence of the Client’s content to provisions of laws about copyright protection of all applicable jurisdictions;
any claims, related to the content;
immediate reaction for notices to the Client (or affiliated persons) by any person, claiming that the Client’s content is infringing the rights of such person.
The Client shall indemnify and hold (company name), its affiliates, subsidiaries and related companies harmless from any losses, claims, obligations or other liabilities related to or arising out of the foregoing.

 

Consent to Recording of Conversations

Any User conversation with the company may be monitored and recorded for quality assurance purposes.

If User does not wish to have a conversation recorded, he/she must notify the representative of the company.

A User’s continued participation in a conversation without expressly requesting for the conversation to not be recorded shall serve as such User’s express consent to have the conversation monitored and recorded.
